The People's Government of Beijing Municipality has approved the Implementation Opinions on Accelerating the Reform of “Multiple-into-one” License Registration System. It has been printed and has now been distributed to you. Please earnestly arrange the implementation of the document’s instructions.

Implementation Opinions on Accelerating the Reform of “Multiple-into-one” License Registration System

 

We are now proposing the following implementation opinions to carry out the Guiding Opinions of the General Office of the State Council on Accelerating the “Multiple-into-one License” Reform (State Council Office Document [2017] No. 41), to further optimize the business environment, accelerate the reform of the “multiple-into-one license” registration system of Beijing Municipality and to continuously reduce the transaction costs relating to the market access system.

I. General Requirements

i. Guidelines

We should carry out in depth the spirits contained in a series of important speeches delivered by Secretary-General Xi Jinping as well as new concepts, new thoughts and new strategies of Secretary-General Xi Jinping for ruling the state and dealing with political affairs, carry out in depth the spirits contained in the speeches of Secretary-General Xi Jinping during his two surveys on Beijing and a series of important instructions about the work of Beijing, and carry out in earnest the arrangements made at the Twelfth Congress of the Communist Party of China of Beijing Municipality. We should accelerate the transformation of government functions, carry forward the “relaxation, regulation and service” reform, and establish a more convenient, relaxed environment for entrepreneurship and innovation as well as a business environment of openness, transparency and fair competition to continuously stimulate the market vitality and innovative force of society, cultivate new development drives and promote the sustainable and healthy development of the economy and society as a whole.

ii. Basic principles

1. Further streamline examination and approve. We should adhere to the principle of combining the “multiple-into-one" license registration reform and the administrative approval system reform, reduce the transaction cost of enterprises and streamline affairs involving corporate affairs in essence by reducing the number of licenses (tables) relating to information collection, recordation, disclosure and administrative reference.

2. Further facilitate access. We should streamline various registration and recordation procedures involving the market access of enterprises, shorten the processing cycle, increase the registration efficiency and facilitate the market access of enterprises to the biggest extent, according to the principle of document simplification, convenient procedure and efficient processing.

3. More effective regulation. Pursuant to the principle of “whoever approves supervises and whoever administers supervises”, we should strengthen the concurrent and ex-post supervision, refine the joint supervision mechanism, establish a supervision mechanism featuring clear division of work, collaboration and joint administration, and jointly establish a market environment of uniformity, openness, fairness, integrity and competition in order.

iii. Working objectives

We should carry forward the “multiple-into-one” reform involving enterprises (including individual economic establishments and rural professional cooperatives, the same below) of Beijing Municipality in different areas in an all-round manner, relax supervision to the biggest extent and carry forward market access facilitation to the biggest extent. We should ensure the reform will be put into practice and make actual effect prior to October 1, 2017, and integrate fifteen licenses in the foreign trade area before the end of 2017.

II. Major Tasks

i. Comb licensing affairs involving enterprises in an all-round manner, and research and make classified action plans

Pursuant to the principle of “whatever should be integrated, simplified and withdrawn, wherever possible”, we should comb and classify licensing affairs involving enterprises in an all-round manner, further integrate enterprise-related licensing affairs of general operation items, including information collection, recordation, disclosure and administrative reference, together with enterprise-related licensing affairs that can satisfy administrative needs of government organs with corporate registration information into the business license, and implement “multiple license integration and one code for one license”. If some affairs can be effectively adjusted through the market mechanism or managed by enterprises at their own discretion or the purposes of enterprise-related licensing affairs can be achieved by strengthening concurrent and ex-post supervision, we should gradually cancel these affairs or replace them with the recordation system. We should continue to reserve enterprise-related licensing affairs that involve public security, economic security, ecological security, production safety and ideological security, implement the access list administration and strengthen risk prevention. We should cancel all enterprise-related licensing affairs that lack the legal basis or are not established through the legal procedure. If some enterprise-related licensing affairs are temporarily not included in the scope of “multiple license integration and one code for one license”, the responsible authority should disclose the catalog, acceptance condition, acceptance standard, document list, review requirement and acceptance time pertaining to these affairs. If some affairs are included in the scope of “multiple license integration and one code for one license”, the coordinating authority and the responsible authority should jointly research and make the integration plan, and specify the integration method and schedule. We should sum up the experience related to the reform in time, consolidate results of the reform and continuously expand the coverage of the “multiple license integration and one code for one license” mechanism. (The Beijing Administration for Industry and Commerce and the Office of Organizational Structure Committee of Beijing Municipality should coordinate the work, and the governments of different districts and related authorities of Beijing Municipality should perform respective responsibilities)

ii. Build the information integration platform and deepen information sharing and business collaboration

We should adhere to combining interconnection and data sharing and connect information islands. We should employ the credit information sharing platform to realize the sharing of basic information and related credit information of enterprises as well as business collaboration between different authorities over a broader scope and in greater depth. We should further refine the remote inquiry system for corporate registration files and realize the sharing of corporate file information between related authorities. Different authorities should catch time to determine the catalog of data resource sharing, forge a government data resource system featuring uniformity, high efficiency, interconnection, security and reliability and smash the barriers of information between authorities and industries. We should control the collection of personalized information pursuant to strict standard. If any information can be acquired through the sharing of information or any document is already collected in the preceding procedure, no authority should require the enterprise to submit such information or document again. If any information can be checked through the network, no authority should require the enterprise to provide such information again. If any information should be surveyed and verified by the administrative authority and related institution, the authority should verify the information by itself, realize “one-off collection, one-file management and sharing between authorities” for the same information, and avoid repeated information registration and submission of same documents by enterprises. (The Beijing Administration for Industry and Commerce and the Beijing Municipal Commission of Economy and Information Technology should coordinate the work, and related authorities of Beijing Municipality should perform respective responsibilities)

iii. Realize the transition for the reform and assure stability and good order of work

New enterprises should submit documents pursuant to the “multiple-into-one” registration requirements, and the registration authority should directly issue the business license bearing the uniform social credit code. If an enterprise has already obtained the business license with uniform social credit code, it will not have to apply for the “multiple-into-one” license registration again, but the registration authority should use the credit information sharing platform to share relevant registration information to related authorities whose licenses are integrated. If the original license of an enterprise expires or it applies for registration change or applies to renew the business license, the registration authority should issue a new business license bearing uniform social credit code. (The Beijing Administration for Industry and Commerce should coordinate the work, and the governments of different districts and related authorities of Beijing Municipality should perform respective responsibilities)

iv. Promote extensive application of the business license with “one code for one license” and promote reform results to land

The governments of different districts, related authorities of Beijing Municipality and various public service institutions should catch time to refine respective information systems, recognize the legal effect of the business license with “one code for one license” when dealing with affairs related to enterprises, and actively promote the application of the business license under jurisdiction and within respective industry. No authority should require enterprises to provide additional documentary evidences for the information of original affairs covered by integrated licenses so that the uniform social credit code will become the only identity code of an enterprise and make the “one code for one license” system generally applicable. (The Beijing Administration for Industry and Commerce should coordinate the work, and the governments of different districts and related authorities of Beijing Municipality should perform respective responsibilities)

v. Strengthen concurrent and ex-post supervision and increase the supervision service efficiency

We should adhere to the combination between convenient access and strict supervision, rely on the credit information sharing platform of Beijing Municipality to continuously refine the information sharing and joint penalty mechanism between different government authorities, lift the level of collaborative supervision and forge a new supervision pattern with credit as the core. We should fully exert functions of the Beijing disclosure system for credit information of enterprises to reinforce self-regulation of enterprises, reduce the transaction risk in the market, reduce the government’s supervision cost and increase the economic operation efficiency. (The Beijing Administration for Industry and Commerce should coordinate the work, and the governments of different districts and related authorities of Beijing Municipality should perform respective responsibilities)

III. Guarantee Measures

i. Reinforce organization and leadership

We should establish the joint meeting system of Beijing Municipality to carry forward the “multiple license integration” reform, plan the reform in an overall manner and coordinate to resolve major difficulties. The office of joint meeting should be set at Beijing Administration for Industry and Commerce, and charged with the responsibility of daily coordination and service support. Related authorities should stress the actual effect of the work and ensure smooth and orderly implementation of the reform by improving respective awareness, paying much attention to the reform, strengthening communication, maintaining close collaboration and making detailed plans.

ii. Strengthen window functions

After the “multiple license integration” reform, the registration window at the basic level will further come under a bigger pressure, and we should assure their staff, facility and fund support. Pursuant to the principle of “affixing staff by position and matching person and position”, the governments of different districts should reasonably adjust and optimize organizational structures and staffing, and enhance the service capacity of the windows through service government and other means, when necessary. We should strengthen the training for staff working at the window, and increase their business capacity. We should strengthen the equipment, software and hardware facilities, and improve the level of information technology application and standardization of registration service.

iii. Stress supervision and evaluation

We should strengthen track and supervision, urge the governments of various districts and related authorities of Beijing Municipality to strictly perform respective responsibilities, and accelerate the work related to the reform. We should make an evaluation and assessment plan, scientifically assess the governments of different districts and related authorities of Beijing Municipality in terms of implementation status and effect of the reform, support the leadership, spur those lagging behind, and fully stimulate their enthusiasm and initiative to do the work.

iv. Strengthen publicity and guide

The governments of different districts and related authorities of Beijing Municipality should make full use of television, Internet, newspapers, Wechat, Weibo and other media to strengthen the publicity of the “multiple license integration” reform, extensively conduct policy interpretation, and make the “one license prevails” concept popular among the public. At the same time, they should pay close attention to public sentiments, strengthen positive guide, respond to concerns from the society in time, and strive to establish a good atmosphere that all circles of the society pay attention to the reform, support the reform and participate in the reform.
